Payment Plan Terms of Service

This Payment Plan Terms of Service (Payment Terms) is a binding legal contract made between you and TrueAccord Corp.  containing the terms and conditions that you must comply with and are bound by if you enter into a payment arrangement through TrueAccord’s payment portal to electronically pay amounts you owe on your past due account placed with our office for collection.

IMPORTANT!  PLEASE READ THIS PAYMENT PLAN TERMS AND CONDITIONS (PAYMENT TERMS) CAREFULLY.  IF YOU DO NOT AGREE TO THESE PAYMENT TERMS YOU SHOULD NOT SET UP A PAYMENT PLAN. YOUR USE OF THE SERVICE CONSTITUTES YOUR ACCEPTANCE OF THESE PAYMENT TERMS, AS UPDATED FROM TIME TO TIME.

GENERAL CERTIFICATION You certify that you are the obligor on the account TrueAccord Corp. is seeking to collect.

PAYMENT AMOUNT(S) AND MANNER You hereby acknowledge and agree to the payment amount(s), frequency, and manner that you chose by opting for a specific plan on TrueAccord’s payment portal reached through a link in our digital communications (our “Payment Portal”). The amount, frequency, and manner you opted for are an integral part of the payment arrangement and include the following: current outstanding balance; starting date for the plan; frequency of payment; number of payments for the plan and dates; payment amounts for the plan; total discount (if any) (your “Payment Details”). 

The Payment Details you chose are emailed to you after you authorize the plan or one time payment.  Payment confirmation emails as well as payment reminder emails (if you authorized multiple payments), will be sent to you—unless you request to receive these payment confirmation and reminder communications through a different medium such as letter or text message.  To do so, please call and speak to an Agent at (866) 611-2731. TrueAccord will not charge for this service.

PAYMENT PROCESSING DATE: TrueAccord will attempt to process all payments by 11:59pm Pacific Time on the date in which the payment is made or scheduled by you.  Sometimes, depending on the system processing times, the payment will be processed on the very next day.  Depending on the payment method, the payment may take up to 8 days to post and clear from your account.  In the event that an outage with the payment gateway prevents processing a payment on the date authorized, TrueAccord will process the payment as soon as the system outage has been fixed.

REGULATION E CONSENT & DISCLOSURE: When you provide bank account or debit card payment information to TrueAccord to process a payment, you authorize TrueAccord either to use the information to make an electronic fund transfer from your account.

ONE-TIME CREDIT CARD AND ACH AUTHORIZATION: If you are making a one time payment by credit card, debit card, or ACH, you hereby authorize TrueAccord to debit the bank account or credit card you entered in our Payment Portal for the noted amount on today’s date, or the date on which your payment is scheduled. This payment is made towards your outstanding balance owed to the creditor. You understand that returns, refunds, and cancellations may be subject to fees and penalties imposed by your financial institution which will be solely your responsibility.  In the case of an ACH, debit, or credit card transaction failing or being rejected for Non-Sufficient Funds (NSF) you understand that TrueAccord may attempt to charge again within 30 business days of the payment failure. You acknowledge that origination of ACH transactions to your account must comply with U.S. law. You certify that you are an authorized user of this card or bank account and that you will not dispute the payment with your credit card company or bank so long as the transaction corresponds to the Payment Details you selected.

RECURRING CREDIT CARD AND ACH AUTHORIZATION: If you are making a recurring payment by credit card, debit card, or ACH, you hereby authorize TrueAccord to debit the bank account or charge the credit card you entered in our Payment Portal for the noted amount on the scheduled dates. This payment is made towards your outstanding balance owed to the creditor. You understand that returns, refunds, and cancellations may be subject to fees and penalties imposed by your financial institution, which will be solely your responsibility. You understand that this authorization will remain in effect until the scheduled end date, or until you cancel it in writing, whichever comes first, and agree to notify TrueAccord at least 7 business days prior to the next payment date. In the case of an ACH transaction being rejected for Non-Sufficient Funds (NSF) you understand that TrueAccord may attempt to charge again within 30 business days of the payment failure. You acknowledge that origination of ACH transactions to your account must comply with U.S. law. You certify that you are an authorized user of this card or bank account and that you will not dispute the payment with your credit card company or bank so long as the transaction corresponds to the Payment Details you selected.

CANCELLATIONS AND REFUNDS: If you want to cancel a payment please call us at (866) 611-2731 or email support@trueaccord.com. A payment may not be eligible to be canceled after it has already been processed.  To request a refund please call us at (866) 611-2731 or email support@trueaccord.com.

ADVANCE PAYMENTS:  At any time you may pay additional payments to TrueAccord, outside your Payment Plan payments or you may pay more than the amount due in each payment of your Payment Plan.

DISCOUNTS AND OFFERS: TrueAccord reserves the right to offer or retract discounts and promotions from time to time at its sole discretion.

COMMUNICATION METHODS CONSENT: You consent to be contacted by TrueAccord, our agents, representatives, employees, affiliates, or anyone calling on our behalf, in any manner, including but not limited to, mail, telephone, SMS (text) messages, pre-recorded/artificial voice or message, automatic telephone dialing system, e-mail, direct drop voicemail, or any other communication method. You also certify, represent and warrant that you are permitted to receive communications at any telephone number, e-mail address, or other address you have provided to TrueAccord, or to the creditor of your debt. You further agree to promptly alert TrueAccord in the event you stop TrueAccording a particular telephone number, email address, or other contact point. You also agree to inform TrueAccord of any shared email address or telephone number in which you do not consent to messages being left or sent. You also consent to the monitoring and recording of telephone communications between you and TrueAccord.

PAYMENT PLANS AND DISPUTES:  If you have an open dispute and you choose to make a one time partial payment, the one time partial payment will not impact your dispute.  Your account will remain disputed.  Outbound collection activity will remain paused, with the exception of the payment confirmation communication about your one time payment.

If you have an open dispute and you choose to set up a payment plan, you will cancel your dispute at the time of your first successful plan payment.  Once the first plan payment successfully processes, your account will be in a payment plan status and you will receive payment reminder and payment confirmation communications.  If you do not want to cancel your dispute, do not set up a payment plan.  If you change your mind after setting up a payment plan and wish to report a dispute, you can submit a new dispute through the online portal (which you can access through any email you received from TrueAccord), by contacting our office at support@trueaccord.com, or 866-611-2731 during business hours.

If you are making payments on a recurring plan you can submit a new dispute through the consumer account pages reached through a link in TrueAccord’s digital communications, by contacting our office at support@trueaccord.com, or 866-611-2731 during business hours.  Your payment plan will be canceled and your account will be in a dispute status.

OTHER TERMS AND CONDITIONS: Additional terms and conditions apply to our website (www.trueaccord.com) and services including our Website Terms of Use, E-Sign Disclosure and Consent, and Privacy Policy which are made a part of this Payment Terms by this reference. You agree to abide by such other terms and conditions.

PRIVACY POLICY: Your privacy is important to TrueAccord. When you use our Service we collect both identifiable and non identifiable information about you (“Information”). ACKNOWLEDGEMENT AND EXCLUSIVITY: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS PAYMENT PLAN TERMS OF SERVICE, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND TRUEACCORD, AND THAT IT SUPERSEDES ANY PROPOSAL, PRIOR AGREEMENT, OR UNDERSTANDING, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU AND TRUEACCORD RELATING TO SERVICE. THIS AGREEMENT MAY BE AMENDED AT ANY TIME AND FOR ANY REASON, AND ANY SUCH CHANGE SHALL BECOME EFFECTIVE UPON POSTING TO THIS WEBSITE. YOUR CONTINUED USE OF THE SERVICE CONSTITUTES YOUR ACCEPTANCE OF THESE CHANGES.
