NATURE OF AGREEMENT: This Agreement is a binding legal contract made between you and TrueAccord Corp., a Delaware Corporation (“TrueAccord”, “We”, “Our”). This Agreement contains the terms and conditions that you must comply with and are bound by if you wish to access and use TrueAccord’s Payment Plan and auxiliary services (“Service”) which allows you to electronically pay amounts you owe on your past due account placed with our office for collection. 

IMPORTANT! YOU MAY ACCESS AND USE SERVICE ONLY ON THE CONDITION THAT YOU AGREE TO THE TERMS AND CONDITIONS SET FORTH BELOW. PLEASE READ THIS PAYMENT PLAN TERMS AND CONDITIONS (“TERMS”) CAREFULLY. 

IF YOU DO NOT AGREE TO THESE TERMS YOU SHOULD NOT USE THE SERVICE. YOUR USE OF THE SERVICE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS, AS UPDATED FROM TIME TO TIME. 

GENERAL CERTIFICATION: You certify that you are the obligor on the account TrueAccord Corp. is seeking to collect. 

PAYMENT TERMS: You hereby acknowledge and agree to the payment terms that you chose by opting for a specific plan on TrueAccord’s Service interface (“Flexible Plan”). The Flexible Plan terms you opted for include the following: Current outstanding balance; Starting date for the plan; Frequency of payment; Number of payments for the plan; Payment amount; Number of late payments approved; Total discount; Total savings. These terms included in Flexible Plan are an integral part of the Terms thereof. 

Please note, your Flexible Plan terms are available for your review at any time at: https://www.trueaccord.com/app/login. If you need more information regarding your account, such as a paper copy or letter stating your status, please call and speak to an Agent at 866-611-2731. TrueAccord will not charge for this service. 

PAYMENT PROCESSING DATE: All payments will be processed by 11:59pm Pacific Time on the date in which the payment is made or scheduled by You. In the event that date falls on a weekend or holiday, the payment will be processed the next business day. 

REGULATION E CONSENT & DISCLOSURE: When you provide bank account or debit card payment information to us to process a payment, you authorize us either to use the information to make an electronic fund transfer from your account. 

ONE-TIME CREDIT CARD AND ACH AUTHORIZATION:If you are making a one time payment by credit card, debit card, or ACH, you hereby authorize TrueAccord to debit the bank account or credit card you entered on our payment form for the noted amount on today’s date, or the date on which your payment is scheduled. This payment is made towards your outstanding balance owed to the creditor. You understand that returns, refunds, and cancellations may be subject to fees and penalties imposed by your financial institution which will be solely your responsibility. In the case of an ACH, debit, or credit card transaction failing or being rejected for Non- Sufficient Funds (NSF) you understand that TrueAccord may attempt to charge again within 30 business days of the payment failure. You acknowledge that origination of ACH transactions to your account must comply with U.S. law. You certify that you are an authorized user of this card or bank account and that you will not dispute the payment with your credit card company or bank so long as the transaction corresponds to the terms of this web form. 

RECURRING CREDIT CARD AND ACH AUTHORIZATION: If you are making a recurring payment by credit card, debit card, or ACH, you hereby authorize TrueAccord to debit the bank account or charge the credit card you entered on our payment form for the noted amount on the scheduled dates. This payment is made towards your outstanding balance owed to the creditor. You understand that returns, refunds, and cancellations may be subject to fees and penalties imposed by your financial institution, which will be solely your responsibility. You understand that this authorization will remain in effect until the schedule end date, or until you cancel it in writing, whichever comes first, and agree to notify TrueAccord at least 7 business days prior to the next billing date. In the case of an ACH transaction being rejected for Non-Sufficient Funds (NSF) you understand that TrueAccord may attempt to charge again within 30 business days of the payment failure. You acknowledge that origination of ACH transactions to your account must comply with U.S. law. You certify that you are an authorized user of this card or bank account and that you will not dispute the payment with your credit card company or bank so long as the transaction corresponds to the terms of this web form. 

CANCELLATIONS AND REFUNDS: If you want to cancel a payment please call us at (866) 611-2731 (tel:(866) 611- 2731) or email support@trueaccord.com (support@trueaccord.com). A payment may not be eligible to be cancelled after it has already been processed.

ADVANCE PAYMENTS:At any time you may pay additional payments to TrueAccord, outside your Flexible Plan payments or you may pay more than the amount due in each payment of your Flexible Plan (“Advance Payments”). 

DISCOUNTS AND SETTLEMENT OFFERS: TrueAccord reserves the right to offer or retract discounts and promotions from time to time at its sole discretion. 

COMMUNICATION METHODS: You consent to be contacted by us, our agents, representatives, employees, affiliates, or anyone calling on our behalf, in any manner, including but not limited to, mail, telephone, SMS (text) messages, pre-recorded/artificial voice or message, automatic telephone dialing system, e-mail, direct drop voicemail, or any other communication method. You also certify, represent and warrant that you are permitted to receive communications at any telephone number, e-mail address, or other address you have provided to us, or to the creditor of your debt. You further agree to promptly alert us in the event you stop using a particular telephone number, email address, or other contact point. You also agree to inform us of any shared e-mail address or telephone number in which you do not consent to messages being left or sent. You also consent to the monitoring and recording of telephone communications between you and us. 

PRIVACY POLICY: Your privacy is important to TrueAccord. When you use our Service we collect both identifiable and non identifiable information about you (“Information”). Note: by agreeing to these Terms and using the Service you also acknowledge and agree to our Privacy Policy. 

E-SIGN CONSENT & DISCLOSURE: This E-Sign Disclosure and Consent applies to all records and communications related to any service provided by TrueAccord Corp.

a. Electronic Form: You agree that We may provide you with records and communications in electronic format. This consent includes, but is not limited to, all legal and regulatory disclosures; communications; notices.

b. Manner of Transmission: You agree that We may provide the records and communications referenced in (a.) (i) by email, (ii) by access to a website designed in an email notice from TrueAccord Corp. to you, or (iii) to the extent permissible by law, by access to a website generally designated in advance for such purpose.

c. Withdrawing Consent: You may withdraw your consent to receive the records and communications in (a.) by contacting us toll free at (866) 611-2731 or at support@trueaccord.com. Once we process your request to withdraw your consent, your access and use of TrueAccord’s Service will terminate. Any withdrawal of your consent to receive electronic records and communications will be effective only after we have had a reasonable period of time to process your withdrawal.

d. Updating Your Information: You are responsible for providing us with true, accurate and complete email address, contact and other information related to this E-Sign Consent & Disclosure and the TrueAccord Corp Services and to maintain and update promptly any changes in that information. You can update your information through our website.

e. Hardware & Software Requirements: In order to access, view and retain the electronic records and communications that we make available to you, you must have:

a. An internet browser that we support, which include Internet Explorer 10.x or higher, Safari 3.2.x or higher, Firefox 32.x or higher and Chrome 38.x or higher, Mac OSX Safari 5 and higher, Safari for iOS 6 and higher, Chrome for iOS, and Chrome for Android;

b. Local, electronic storage capacity to retain Records or Communications or a printer to print them;

c. A valid email account and software to access that email account;

d. An up-to-date device or devices (e.g., computer, tablet, mobile phone, etc.) suitable for connecting to the Internet and supported by TrueAccord Corp.;

e. An operating system capable of receiving, accessing and displaying Records and Communications from us in electronic form via text-formatted email or access to our website using a supported browser.

f. Requesting Paper Copies: We will not send a paper copy of records or communications unless you request it or we otherwise deem it appropriate to do so. You can obtain a paper copy of your electronic records and communications by printing it yourself or by requesting that we mail you a paper copy. To request a paper copy of any particular record or communication, contact us toll free at (866) 611-2731 or at support@trueaccord.com. Please make sure to state that you are requesting a paper copy of a particular record or communication. We do not charge a fee for providing a paper copy of records or communications.

g. “In Writing” Designation: All records and communications in electronic or paper format from us to you will be considered “in writing”. You should print or download for your records a copy of this E-Sign Consent and any other electronic records or communications important to you.

h. Federal Law: You acknowledge and agree that this E-Sign Consent is being provided by you in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act, and that you and TrueAccord Corp. intend the Act to apply to the fullest extent possible under the law.

i. Termination/Changes: TrueAccord Corp. reserves the right, in its sole discretion, to discontinue the provision of electronic records and communications, to terminate, or to change the terms and conditions under which it provides electronic records and communications. We will provide you with notice of any such change or termination as required by law.

j. Consent: You hereby give your affirmative consent to receive electronic records and communications as described in this E-Sign Consent and Disclosure. You further agree that your computer or other device satisfies the hardware and software requirements specified above and that you have provided True Accord Corp. with a current email address at which it may send you electronic records and communications. 

ACKNOWLEDGEMENT AND EXCLUSIVITY: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND TRUEACCORD, AND THAT IT SUPERSEDES ANY PROPOSAL, PRIOR AGREEMENT, OR UNDERSTANDING, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATION BETWEEN YOU AND TRUEACCORD RELATING TO SERVICE. THIS AGREEMENT MAY BE AMENDED AT ANY TIME AND FOR ANY REASON, AND ANY SUCH CHANGE SHALL BECOME EFFECTIVE UPON POSTING TO THIS WEBSITE. YOUR CONTINUED USE OF THE SERVICE CONSTITUTES YOUR ACCEPTANCE OF THESE CHANGES.
